Legal Update – May 14, 2024 – 10 am EST – 11 am EST
Presenter: Derrick T. Wright – Attorney with Sturgill, Turner, Barker & Moloney, PLLC
Description: The presentation will provide updates and guidance addressing new developments from regulatory action and court decisions within the wage and hour area of law. Regulatory developments from the federal Department of Labor include a new final rule changing the independent contractor test and an impending rule expected to sharply increase the minimum salary for exempt employees with automatic three-year reviews. For the minimum salary rule amendment, the presentation will overview the substance of the rule change and salary calculation, discuss preparation dos and don’ts, and preview potential legal challenges.
With respect to court actions, the presentation will explore ongoing litigation addressing whether college athletes qualify as employees and a very new jury verdict awarding nearly $100,000,000 for timeclock rounding errors that are often overlooked. In addition to these current issues, the presentation will conclude with potential future legislative action that might impact workers by lowering the standard 40-hour workweek or mandating employee leave.

Description: This session will cover the topic of pay equity, specifically about what institutions should do to help eliminate future pay inequities. There’s not an overnight solve for pay equity, but there are many things that can be done to prevent new issues from arising. We’ll touch on some easy calculations to identify issue areas, how to be smart with the use of market data, simple ways to address pay compression, and much more.

2022 Spring Unconference - May 9th-27th (Three Week Series)
Kentucky and Tennessee CUPA-HR tried something a little different during the spring of 2022, where the two boards joined up again to deliver our joint spring event. Both or our membership populations where telling us they wanted more opportunities to network with their peers, so we are called our event last spring an unconference! The programming allowed participant centered, steering away from the traditional formal presentations.
This Unconference contained a series of single sessions over a three-week period from May 9th through May 27th, with no more than one session on any given day and each week and had no more than three sessions.
The event was conducted entirely online in a virtual environment.

Round Table Discussion Series
Your Kentucky CUPA-HR Board introduced a new program for 2022. We rolled out a new series called Kentucky CUPA Connect. A quarterly roundtable discussion covering different issues facing our departments, campuses and profession. These discussions where heavily participant centered and offered our entire membership a chance to participate in these very important discussions. If you have an idea of a topic or you are interested in facilitating a quarterly event in the future; please reach out to any member of your Kentucky board.
Our first quarterly roundtable was March 31, 2022, and covered the topic of Recruitment.
Our second quarterly roundtable was June 30th, 2022 and covered Performance Management.
Our third quarterly roundtable was September 30th, 2022, and covered Onboarding.
I hope you were able to join us for one or all of these roundtables, but if not keep your eyes open for more opportunities to join you peers to discuss some very important topics facing all of our campuses.
