This presentation will look at cases and regulatory guidance related to how incivility can lead to legal liability and the measures that go beyond just policies to implementing a culture of civility and inclusiveness. In addition, the presenter will provide scenarios (that are applicable to academic workplaces) and lead the attendees in discussion of best practices for addressing problems behaviors in the scenarios.<\/p>\n<p><strong>About Andrea:<\/strong> Andrea advises employers on risk management issues in the workplace and represents employers of all types and sizes before administrative agencies in discrimination, whistleblower, unemployment, and wage disputes. She conducts in-house trainings for employers and serves as an outside investigator for employers who need to respond to highly sensitive internal complaints of discrimination and harassment. She is a frequent public speaker on employment law issues. Andrea is admitted to practice in New Hampshire and Massachusetts. Andrea is listed in Chambers USA as one of the leading employment lawyers in New Hampshire and in Best Lawyers of America\u00ae for Employment Law \u2013 Management (recognized in 2019 as \u201cLawyer of the Year\u201d in Manchester for Employment Law \u2013 Management). Andrea received the 2022 Ry Perry HR Hero Award at the Granite State HR Conference. In addition, she is the Government Relations &amp; Legislative Chair for the HR State Council of New Hampshire. She also serves as the Vice Chair of the HR\/Healthcare\/Workforce Development Committee for the Business &amp; Industry Association of NH.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Caitlin Goss,<\/strong> <em>Middlebury College<\/em><br \/>\n<strong>Program:<\/strong> Iterate &amp; Innovate: an interactive workshop on organizational design through a design thinking lens<\/p>\n<p><strong>Synopsis:<\/strong> This workshop will guide participants through the five stages of design thinking and ask them to consider their own HR department \u2014 or another area of their institution \u2014 from an organizational design lens. We will touch on succession planning, change management, asking hard questions and bringing stakeholders along. Participants will leave with a set of ideas and questions (maybe more questions than answers!) about their particular organizational design challenge but also with an understanding of design thinking as a tool and an ability to bring it to future conversations.<\/p>\n<p><strong>About Caitlin:<\/strong> A native Vermonter who grew up in Hinesburg, Caitlin Goss holds an MBA in sustainable innovation from the University of Vermont and a bachelor\u2019s in political science and East Asian studies from Dickinson College. As an exchange student, she attended Beijing University, where she became fluent in Mandarin Chinese. Goss also spent two years at the Harvard Kennedy School of Government, where she worked and studied leadership as a vehicle for systems change and developed a keen interest in the nonprofit sector and an understanding of the dynamics within a research and teaching institution.<br \/>\nGoss comes to Middlebury from Rhino Foods in Burlington, where she has served as the director of people and culture for the last four years. Previously, she was the team leader for employee engagement in global human capital at consulting firm Bain &amp; Company, where she worked in the Boston and Shanghai offices.<br \/>\nGoss also has been highly engaged in her local communities as a volunteer and board member. She is currently a member of the board for Vermont Works for Women.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Elizabeth Johnson,<\/strong> <em>Verrill Dana, LLP<\/em><br \/>\n<strong>Program:<\/strong> Investigation Essentials for Higher Ed<\/p>\n<p><strong>Synopsis:<\/strong> This presentation will focus on foundational best practices for conducting investigations, both in the workplace and as part of the Title IX investigation process. During the session, attendees will gain insights on determining when to investigate, conducting a thorough and fair investigation, interview and report drafting techniques, and more to help them effectively prepare for and execute an investigation when warranted. In addition, this presentation will address key distinguishing factors to keep in mind when investigating Title IX matters, including complying with the new Title IX regulations.<\/p>\n<p><strong>About Elizabeth:<\/strong> Liz helps clients find practical solutions for employment-related needs and navigate the evolving employment law landscape. Liz\u2019s practice centers on helping employers stay up-to-date and in compliance with their legal obligations while maintaining a tailored approach with clients\u2019 specific goals in mind. Liz regularly advises clients on a diverse range of employment matters, including wage and hour matters; harassment, discrimination, and retaliation claims; employee leave (FMLA, ADA, paid leave programs, workers\u2019 compensation); reasonable accommodations; diversity, equity, and inclusion; investigations; employee agreements; restrictive covenants; employee handbook and policy preparation; and supervisor and employee training. In addition, Liz represents clients in employment litigation in state and federal courts, as well as before administrative agencies such as the Maine Human Rights Commission and Equal Employment Opportunity Commission. Liz is also a skilled investigator. She maintains an active workplace investigations practice and is trained in Title IX investigations for higher education institutions. During law school, Liz served as a Bernstein Fellow at the Maine District Court and a judicial extern to the Honorable Kermit Lipez of the United States Court of Appeals for the First Circuit. After law school, Liz clerked for the Honorable Andrew M. Higher ed leaders can stay one step ahead of these changes by using data not just to react but to anticipate and plan ahead. In this presentation, you will learn how you can use CUPA-HR data to: 1) plan for ongoing changes to the DOL\u2019s FLSA overtime rule; 2) improve retention in the face of higher turnover rates; 3) decrease leadership gaps that have widespread repercussions; and 4) benchmark department sizes in the face of restructuring challenges.
